Shields Wildlife Removal
1 Year Basic Wildlife Limited Warranty Agreement
This Wildlife Removal Services Warranty Agreement (“Agreement”) is entered into by and between [Shields Wildlife/ Shields LLC], (“Provider”), and [Client Name Per Invoice], an individual/entity with its principal address located at [Client Address Per Invoice] (“Client”), collectively referred to as the “Parties.”
Purpose
The purpose of this Agreement is to ensure that wildlife removal services provided by the Provider meet the specified standards, focusing on the removal, management, or exclusion of wildlife pests (such as rodents, raccoons, bats, squirrels, etc.) only as outlined in the original estimate or invoice.
Scope of Warranty Coverage
The warranty provided under this Agreement is strictly limited to the work performed and the areas covered in the original estimate or invoice. The Provider will not be responsible for addressing any additional issues or wildlife pests that fall outside the scope of the work outlined in the original estimate or invoice. Specifically, this includes:
-
Exclusion Work: Only the entry points that were sealed as part of the original scope of work per the invoice.
-
Target Animal Removal: Only the removal of wildlife pests identified in the original estimate or invoice (e.g., bats, raccoons, rodents, etc.) and related work performed specifically to address those identified issues.
If additional wildlife issues arise or if other entry points are discovered that were not covered under the original scope, a new quote will be provided to address those issues. The warranty will not cover any work outside of the areas and issues addressed in the original estimate or invoice.
Warranty Period
Provider guarantees the work performed under this Agreement for a period of 12 months from the completion of services per the invoice date. During this period, Provider warrants that:
-
Wildlife Re-entry: If the targeted wildlife pests, identified in the original estimate or invoice, re-enter the premises through the areas that were sealed or worked on by the Provider, the Provider will re-perform the services at no additional charge to remove the pests and re-seal the entry points.
-
Exclusion Integrity: The entry points sealed by the Provider within the scope of the original estimate or invoice will remain secure under normal conditions, preventing re-entry of the targeted wildlife pests. If pests re-enter through the areas that were sealed under the original scope, the Provider will return to address the issue.
Warranty Coverage
The warranty provided under this Agreement is strictly limited to the work performed as outlined in the original estimate or invoice. Specifically, the warranty will only cover:
-
The sealed entry points and areas that were identified and addressed under the scope of the original estimate or invoice.
-
The specific wildlife pest(s) that were identified and removed in the original estimate or invoice (e.g., bats, raccoons, rodents, etc.).
The warranty will not cover:
-
Any new or different wildlife pests or animals not identified and addressed in the original estimate or invoice. For example, if a new animal such as a squirrel, opossum, or different species of rodent enters the property, this will not be covered by the warranty. A new quote will be provided to address any additional wildlife issues outside the original scope.
-
Any new entry points or areas that were not covered under the original estimate or invoice. For example, if new holes or gaps are found in different areas of the home or structure, these will not be covered under the warranty and will require a new quote for additional work.
In the event that the client identifies any new issues not covered under the original scope, the Provider will not be responsible for any additional work under this warranty. A new quote will be provided for any additional work required to resolve the newly identified problems. Any additional services beyond the scope of the original agreement will be treated as a new project, subject to separate pricing and terms.
Exclusions
This warranty does not cover:
-
New or Different Wildlife Infestations: Any wildlife pests or animals not identified and addressed in the original estimate or invoice. If a new pest issue or different type of animal arises, a separate quote will be provided for the new services needed.
-
Damage from Natural Disasters: Damage caused by natural disasters such as storms, floods, etc.
-
Client Negligence: Failure of the Client to maintain the property properly as recommended by the Provider (e.g., leaving doors or windows open, failing to address food sources, etc.), which could void the warranty.
-
Third-party Actions: Any damage or pest re-entry caused by third-party activities such as construction, neighboring wildlife issues, or unapproved pest introduction.
No Refunds
The Parties agree that under no circumstances will the Provider issue a refund for any wildlife removal services rendered under this Agreement. The warranty provided by the Provider constitutes the sole remedy available to the Client for any issues arising from the services, and it will only apply within the scope of the original estimate or invoice.
Should new wildlife-related issues arise, the Provider will be happy to assess the situation and address any concerns. However, such issues will not be covered under the current warranty. Instead, a new quote will be provided for any additional work required to resolve the newly identified problems. Any additional services beyond the scope of the original agreement will be treated as a new project, subject to separate pricing and terms.
If it is determined that the issue stems from a new animal or entry point not covered in the original estimate or invoice, the warranty will not apply, and the Client will be required to pay for any necessary repairs or services outside of the original agreement.
Limitation of Liability
Provider’s liability under this warranty is strictly limited to the re-performance of services related to the areas and wildlife pests covered by the original estimate or invoice. The Provider will not be liable for any indirect, incidental, or consequential damages resulting from the presence of wildlife pests, including health risks or property damage caused by the pests prior to removal.
Termination
This Agreement may be terminated by mutual consent or due to a breach by either party. If, after an inspection, it is determined that none of the work performed by the Provider under the original estimate/invoice is the cause of the issue, the Provider is not required to perform additional work. This will be counted as one of the two free warranty inspections provided.
Inspections can also be terminated if [Shields Wildlife/ Shields LLC] finds no evidence that the target animal has re-entered the home within the areas outlined in the original scope of the invoice.
How to File a Warranty Claim
To file a warranty claim, simply contact us within the warranty period. We will schedule a visit to assess the situation and address any issues covered by the warranty within the scope of the original estimate/invoice. If necessary, we will re-seal entry points, conduct further removal, or provide any other covered services at no additional charge.
Terms & Conditions
-
First Year Warranty: The first year of warranty coverage is provided at no additional cost to the Client.
-
Subsequent Years: For any additional years of coverage beyond the first year, the warranty fee will be 15% of the total cost of the original wildlife removal services for the first year, and 10% of the total cost for each subsequent year of coverage.
-
Warranty Activation: The warranty will only become effective once the total balance of the Client’s invoice is paid in full. If the Client is on a payment plan, the warranty will not be valid until the entire balance of the payment plan is caught up and in good standing. Any outstanding or overdue payments will result in the warranty being voided until the account is made current.
-
Property Coverage: The warranty is valid only for the property that received the original wildlife removal and exclusion services as outlined in the original estimate or invoice. Additional properties are not covered.
-
Client Responsibility: Failure to maintain your property in accordance with the Provider’s recommendations may result in the voiding of the warranty.
